This website (the "Micheline Mireille Collective") and/or the services, including all mobile applications connected to it and any offer or sale of products (the "Products") through the Site, are owned and operated by Collectif Micheline Mireille, individual reason (hereinafter also referred to as “we”, “us” or “our”). These Terms of Business (the “Terms”) set forth the terms and conditions under which visitors or users (collectively, the “user” or “you”) may visit or use the Site and/or Services and purchase Products.

These Terms are provided in the French language.  In the event of any discrepancy between the French version of this document and any of its translations, the French version shall prevail.

To use our Site and/or take advantage of our Services, you must have the legal authority, right and power to sign these Terms as a binding agreement.

The photographs, drawings and descriptions of the Products and/or Services are provided for information purposes only and do not bind us.
We invite you to refer to the information and instructions for use that appear in the description of the article. We cannot be held liable for any damage resulting from non-compliance with these instructions for the use of the Products and/or Services provided on our website.

Purchase of Products

Any purchase of Products is subject to the Terms applicable at the time of such purchase.

(2) When purchasing a Product: (i) it is your responsibility to read the complete list of items before committing to purchase them; and (ii) placing an order on the site (by completing the payment procedure by pressing the "Buy" button or a similar button) may lead to a legally binding contract for the purchase of the relevant Product, unless otherwise specified otherwise in these Terms.

(3) The prices we charge are indicated on the Site. We reserve the right to change our prices or correct any pricing errors that may inadvertently occur at any time. By pressing the "Buy" button, you place a firm order to purchase the advertised Products at the price and with the shipping costs indicated. To complete the ordering process by clicking the "Buy Now" button, you must first accept these Terms as legally binding for your order by ticking the relevant box.

(4) The legally binding contract for the purchase of the Products is only concluded when we send you a notice of acceptance by e-mail or when we deliver the Products to you. We reserve the right not to accept your order.

Delivery of Products

Upon receipt of payment, order is usually processed within 1-5 business days for in-stock items.

Prices and delivery times vary depending on the type of Products ordered, the delivery address and the delivery method chosen.

The applicable prices and delivery times will be communicated to you before confirming your order.

Refund and return policy

If a manufacturing defect is found, the Customer is required to inform the seller by email with a precise description (a photograph may be required), within 5 days, otherwise the defect is considered accepted. In the event of a proven defect, the seller undertakes to replace the goods according to the available stocks or to reimburse the amount of the article to the bank account indicated by the Customer, as soon as the goods have been received in return. The order confirmation must be attached to the goods returned to the following address: Collectif Micheline Mireille, Chemin du Levant 1 – 1805 Jongny.

Product Warranty

The warranty does not cover the natural wear and tear of the product, damage caused accidentally, as well as damage occurring during incorrect use or due to non-compliance with the instructions for use.

Availability of goods

On the site, the products are offered for sale while stocks last. If, despite its vigilance, the items offered are unavailable, the seller will inform the Customer. The item will then be replaced by another or the order will be refunded. The seller cannot be held liable. Special offers, promotions or discounts will only be valid until the date indicated or while supplies last.

Limitation of Liability

To the fullest extent permitted by applicable law, we disclaim all liability for any amount or type of loss or damage which may arise to you or any third party (including any direct or indirect loss and any loss of revenue, profits, customers, data, contracts, and any loss or damage resulting from or related to business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time , even if foreseeable, in connection with (i) this Site and its contents, (ii) the use, inability to use, or results of the use of this Site, (iii) any site website linked to this Site or the documents present on these linked websites.
We cannot be held liable for any delay or breach of our obligations arising from these Terms if such delay or breach results from a cause beyond our control and/or a case of force majeure within the meaning of article 1216 of the Civil Code.
We cannot accept any liability for the accuracy, correctness, timeliness, reliability and completeness of this information. We cannot be held liable for material or immaterial damage that may be caused by access to the information disseminated or by its use or non-use, by the misuse of the connection or by technical problems.

Modification of the Terms or Services; interruption

(1) We reserve the right to modify these Terms whenever necessary, at our sole discretion. You should therefore consult them regularly.

We may modify the Services, stop providing the Services or any features of the Services we offer, or create limits for the Services. We may terminate or suspend access to the Services permanently or temporarily for any reason, without liability.

The Services may include links that take you out of the Site. Unless otherwise stated, the linked sites are not under our control and we are not responsible for their content, or any links they contain, or any changes or updates to them. Personal data is treated strictly confidentially and is neither sold nor communicated to third parties. No personal data is recorded when accessing our site.

These Terms shall be governed by and construed in accordance with the laws of Switzerland, excluding conflict of law rules.

No waiver of any breach or default hereunder shall be deemed a waiver of any prior or subsequent breach or default.

The section titles used in these Terms are for convenience only and have no legal substance.

Unless otherwise stated, if any part of these Terms is determined to be illegal or unenforceable for any reason, it is agreed that that part of these Terms will be severed, the other terms of these Terms will not be affected and will remain in force.

By accepting the Conditions, you undertake not to contest the probative value of the documents exchanged via the Site, on the basis of their electronic nature. Computerized records are considered proof of communications, orders and payments made between us.
